2004-2005 peugeot design contest
automobiles peugeot, a french public limited company with capital of 171,284,850 €, whose registered office is located at “75, avenue de la grande armée – 75116 paris – france”, registered on the paris trade and companies register under number b 552 144 503 and referred to hereafter as “peugeot”, is holding a contest entitled “3rd peugeot design contest”, which is only accessible via the internet.
any person aged 14 or over can enter the contest, with the exception of employees of the psa peugeot citroen group, employees of other automobile manufacturers and those of euro rscg, as well as members of their family and, as a general rule, any person who was directly or indirectly involved in organizing the contest.
purpose of the contest
participants must design and draw a vehicle around the following theme: “design the peugeot you dream of seeing in the near future” and attach a written description to their design explaining their concept.
the main factors taken into account by the judges will be the originality of the concept and the clarity of the explanation, loyalty to peugeot’s brand values, the creativeness of the design and the quality of the finished product.
at the end of the contest, peugeot will build a full-scale model of the winning design, which will be unveiled at the frankfurt motor show in september 2005.
deadline for entry
web users will be able to submit their design by e-mail only between 15th october 2004 and 8th december 2004 at 12:00 am [midnight], french time.
terms and conditions of entry
it will only be possible to enter the contest via the internet:
- via the url for peugeot’s websites [http//www.peugeot.com] or those specific to the contest [http//www.peugeot-concours-design.com],
- via links from the peugeot websites of the participating countries
to enter, web users must visit the dedicated website mentioned above and send the following by email [using the instructions on the website]:
• the entry form that will appear on the screen, duly completed,
• their design, representing the peugeot motor vehicle [.jpg format, max. 500kb],
• an explanation of the vehicle concept [in french, english or spanish; .txt format only, max. 100kb].
it is essential that all the information requested on the form be provided in order to enter the contest.
incomplete or incorrect entries, or entries from persons who do not meet the required criteria will be disregarded.
participants may enter several designs [and concepts].
selection procedure and methods
peugeot will select a maximum of 30 designs from all the designs received.
peugeot will send the authors of the 30 designs selected a letter containing an undertaking of copyright assignment form for their design, in accordance with the assignment terms and conditions provided in article 9. this form must be signed and returned to peugeot by first class post before 14th january 2005 at 12:00 am [midnight] french time [the postmark will serve as proof], so that the participant’s entry can be considered during stages 2 and 3.
indeed, any such letter not received by peugeot by the aforementioned date [14th january 2005] will lead to the automatic disqualification from the contest of the participant in question. consequently, such participant will have no right to receive a prize or compensation for his/her design.
the designs finally selected after the aforementioned letters have being received will be shown on the peugeot website, and on the websites devoted to the contest by peugeot’s subsidiaries, between 16th and 23rd december 2004.
web users and members of the european automotive press selected by peugeot will vote for a maximum of 10 out of the 30 designs initially selected; after analysing these votes, the peugeot jury, comprised of peugeot employees with experience in the field of automotive design and chaired by frédéric saint-geours, the general manager of peugeot, will draw up a list of 10 designs.
the 10 designs selected will be shown online between 20th and 27th january 2005.
the peugeot jury will choose a winner from the 10 designs selected in stage 2. it will also name 2nd and 3rd place entries.
the identity of the winner will be revealed on the peugeot websites between 14th and 20th february 2005.
the other winners of the will be notified in writing as of 14th february 2005.
the following prizes will be awarded:
• to the winner, in addition to building and exhibiting a full-scale model of their design:
- a sum of 6,000 € inc. vat
- an invitation for one person to take part in the 2005 geneva motor show [march 2005] for at least one day, including accommodation and full board worth around 200 € inc.vat.
peugeot will cover the cost of a return ticket in economy class from the home of the winner to the show, the form of transport selected being entirely at peugeot’s discretion.
- the “la griffe” trophy, which they will receive at the 2005 geneva motor show
- an invitation for two people to take part in the 2005 frankfurt motor show [september 2005] for two days, including accommodation and full board worth around 400 € inc.vat.
peugeot will cover the cost of return ticket in economy class from the home of the winner to the show, the form of transport selected being entirely at peugeot’s discretion.
in addition, peugeot is already planning to reproduce the winning design in the form of 1/43rd scale miniature vehicles, which would be marketed by norev [see article 9: related products].
• for the runner-up
- a sum of 3,000 € inc. vat
• for third place:
- a sum of 2,000 € inc. vat
• for the finalists in 4th to 10th place inclusive:
- a sum of 1,000 € inc. vat
• for the short-listed designs in 11th to 30th place inclusive:
- a sum of 300 € inc. vat
and for all the finalists in 1st to 30th place:
- a presentation box [produced by norev] containing a 1/43rd scale model of the 4002 [the winning concept car at the second peugeot design contest, designed by stefan schulze] worth around 35 € inc. vat
the prizes offered to the winner can only be awarded in the form described in the rules. they cannot be exchanged for cash or replaced for any reason whatsoever.
prizes awarded but which remain unclaimed by 31st march 2005 cannot be claimed after this date.
additional prizes may subsequently be added to those mentioned above; if this is the case, notification will be provided during the course of the contest.
by taking part in the contest, entrants acknowledge that the exposure generated for their design, as a result of the publicity given to it by peugeot, also constitutes substantial compensation for the rights granted to peugeot as described in article 9.
by taking part, the winner authorizes peugeot to use their surname, forenames, address and image for commercial and/or advertising purposes, within the scope of this design contest and future design contests.
use of the designs by peugeot and by their authors
any person who submits a design with the intention of entering this contest certifies and guarantees that they are the sole author of the work and that no third-party rights have been breached either directly or indirectly.
use of the designs:
by taking part in the contest, entrants grant free and non-exclusive license on their design, so that if their design is selected by peugeot at the end of the first stage:
• it may be placed online, on the “http://www.peugeot.com” and/or “http://www.peugeot-concoursdesign.com” websites and/or on the peugeot websites of participating countries, so that the jury for the second stage may designate the 10 designs to be submitted to the jury for stage 3,
it may be reproduced and represented by peugeot or with peugeot’s authorization, in all countries of the world and for the duration of the copyright period, in any medium related to this edition of the contest and to all past and future editions of the peugeot design contest, not including the purchase of advertising space. in particular, this will include: peugeot press files, peugeot websites or peugeot’s partners’ websites, the peugeot museum, peugeot
avenue websites, peugeot institutional films, national and international motor shows, all types of television programme, brochures for motor shows and motor museums, etc…
it may be reproduced and represented, in all the countries of the world and with peugeot’s authorization, in the press, on television or on the internet, for a period of two years from the date peugeot announces the 30 designs selected, in any mediumrelated to this edition of the contest and to all past and future editions of the peugeot design contest, in particular with a view to promoting the next peugeot design contest. peugeot agrees that it will not use the non-winning designs in any way not covered by the provisions of this article. the authors of these designs will be free to use them as they wish.
copyright assignment by the authors selected at the end of the first stage and by the winner of the contest:
by entering the contest, the winner undertakes to assign his/her copyrights relating to his or her design to peugeot citroen automobiles [peugeot sister company which holds rights to the design of all peugeot vehicles] for the duration of the copyright period and for all countries. these rights include the rights to reproduce, represent and modify the design in any way or form, using any process and in any medium, present or future. most notably, this means that peugeot citroen automobiles may modify the winning design in any way it judges necessary, in particular when building the full-scale model of the winning design for the frankfurt motor show. in addition, peugeot citroen automobiles may register the design of the winning vehicle as a design and model in all countries, in its own name and at its own cost, should it so wish. the winner agrees to complete and sign any document that might be necessary for such registeration. this copyright assignment is subject to french law.
by simply entering the contest, entrants undertake to provide peugeot citroen automobiles with confirmation that they will assign the copyrights related to their design in accordance with the terms and conditions stipulated in article 6 [stage 1].
should any of the designs selected have been drawn by a minor, under the terms of the law that applies in his or her country, the legal guardians of this minor must countersign the waiver form signed by the minor who has entered the contest.
contest entrants acknowledge that the prizes awarded to the winner and the publicity they receive thanks to peugeot also constitute compensation for assignment of the rights to their design and for the various authorizations granted to peugeot.
name of the winning vehicle:
should they so wish, authors of designs may suggest a name for their project, which is to be sent to peugeot with their entry. however, by entering this contest the winner agrees that peugeot may change the name of the vehicle at any time for any reason whatsoever, in particular depending on the legal availability of the name.
if one of the designs selected has no name, peugeot will be free to name the design as it wishes.
in any case, by entering the contest the future winner agrees to assign his/her rights to any name they may have suggested for his or her vehicle, if indeed this is the name ultimately used by peugeot.
the winner agrees to confirm that they have assigned these rights, upon receipt of a letter from peugeot regarding this point. in addition, the parties agree that the final name of the winning vehicle may be registered as a trademark by peugeot, in its own name and at its own cost, in all countries of the world.
peugeot is already planning to reproduce the winning design in the form of 1/43rd scale miniature vehicles, which would be produced and marketed by norev.
peugeot may also wish to produce other scale models of the winning vehicle, of different sizes.
by simply entering the contest, the future winner authorizes peugeot to provide the manufacturers of the scale models with authorization to reproduce his or her vehicle. the name of the winner will of course be inscribed on the packaging, as they are the vehicle’s designer. the winner will be kept regularly informed of how production is progressing. several of these miniatures will be given to the winner free of charge, and he or she will also receive an annual sum, excluding vat, equivalent to 1% of the turnover, excluding vat, generated by the manufacturer from all sales of miniatures produced over the course of the elapsed year, as compensation for their manufacture.
the future winner of the contest agrees, simply by entering the contest, to provide peugeot with confirmation of this authorization upon receipt of peugeot’s letter reminding them of the terms and conditions relating to these reproductions.
peugeot may also wish to produce other related products in which the vehicle will be reproduced or represented, or to authorize third parties to reproduce or represent the vehicle [for example in a computer game, on key-rings, on lapel pins, on tee shirts, in a comic strip, in a film, etc…], in particular with the aim of generating publicity for the winning project. by simply entering the contest, the future winner agrees to examine the terms and conditions of this reproduction with peugeot, which will form the basis of a subsequent written agreement between the winner and peugeot.
refund of expenses
entry into the contest is free of charge. the cost of the phone call required to take part in the contest [internet connection to the website] will be refunded by bank transfer upon written request from the entrant, accompanied by his or her bank details, sent to:

the amount refunded will be calculated on the basis of a fixed estimate of the connection time required to enter of 10 minutes, that is 0.46 € inc. vat.
the stamp used to send the rights assignment form will be refunded by bank transfer upon written request accompanied by the entrant’s bank details, at the rate in force for first class post [only one refund per household and per design submitted].
the computer file generated when a participant enters the contest is declared to the commission nationale informatique et libertés française [french data protection authority] in accordance with the provisions of the law passed on 6th january 1978.
the information gathered within the scope of this contest will be used exclusively by peugeot, its subsidiaries and their distribution networks.
contest entrants whose personal information has been recorded have the right to access, modify, correct and delete any data that concerns them [articles 34 to 40 of the french “informatique et libertés” [data and freedom] law no. 78-17 of 6th january 1978]
to exercise this right, entrants must write to:

peugeot reserves the right to curtail, extend, modify or cancel the contest in the event of acts of god or if circumstances beyond peugeot’s control should require it, and may not be held liable as a result.
similarly, the organizer shall not be held liable in the event that participants find it difficult or impossible to access or consult the peugeot websites.
rules and disputes
by entering the contest, participants agree to all the provisions of these rules. disputes of any type relating to these rules or to the contest will ultimately be settled by peugeot.

in the event of differences between the english and/or spanish versions or any other language version the rules have been translated into, only the french version of these rules will be binding.
this contest is subject to french law.
